Scope and Commitment
T MARK BUILDING INSPECTION – L.L.C – S.P.C (hereinafter referred to as “the Company” or “T MARK”) is committed to maintaining the highest standards of data privacy in accordance with the UAE Federal Decree-Law No. 45 of 2021 regarding the Protection of Personal Data. This policy governs the collection, processing, and disclosure of information obtained through our website and professional services.
Data Collection & Source
We collect personal and property-related data directly from you or your authorized representatives. This includes, but is not limited to, names, contact details, property locations, and access credentials. By providing this information, you warrant that you have the legal right to disclose such data to the Company.
Purpose of Processing Data processing is strictly limited to:
- Executing the service agreement (scheduling and conducting inspections).
- Generating and delivering technical snagging reports.
- Regulatory compliance and internal quality auditing.
Data Security & Confidentiality
The Company employs advanced technical encryption and organizational measures to protect data against unauthorized access. All inspection findings and reports are classified as “Confidential” and are stored on secure servers with restricted access.
Third-Party Disclosure & Indemnity
No Commercial Sharing: The Company shall not sell or lease personal data to third parties for marketing purposes.
Developer/Contractor Interaction: Inspection reports are shared with developers or contractors only upon the Client’s explicit request. The Company is not responsible for how these third parties handle the data once shared.
Legal Obligations: We reserve the right to disclose data if required by UAE judicial or governmental authorities.
Data Retention & Legal Defense
The Company shall retain records of inspections and personal data for a period necessary to fulfill its contractual obligations and for a duration that allows the Company to defend itself against potential legal claims, in accordance with UAE statutes of limitation.
Limitation of Liability for Information Accuracy
The Client is solely responsible for the accuracy of the information provided (e.g., property boundaries and ownership). T MARK shall not be held liable for any errors in inspection reports resulting from inaccurate or incomplete information provided by the Client.
General Limitation of Liability & Force Majeure
The Company’s inspection is a visual, non-invasive assessment of the property’s condition at the specific time of inspection. T MARK shall not be held liable for any latent defects, structural issues, or deficiencies that are hidden, inaccessible, or not detectable through standard visual inspection methods. Under no circumstances shall the Company be liable for any indirect, consequential, or incidental damages, including but not limited to loss of profits or repair costs exceeding the original service fee paid by the Client. The Company is further released from any liability arising from delays or failure to perform due to circumstances beyond its reasonable control (Force Majeure).
